Hocking County, Ohio’s recount whistleblower, Sherole Eaton — who was recently fired without explanation in the wake of having reported on a voting company employee tampering with the hard-drive of a central tabulating computer and offering “cheat-sheets” prior to the recount of the November 2004 Presidential Election — received some support yesterday from both a Court Order and several dozen backers at a dramatic Board of Elections meeting.
Attorney Cliff Arnebeck, one of the attorneys who filed a case in Ohio to have the November Election results set aside due to evidence of fraud, served County Board of Elections officials with a court order mandating Eaton not be replaced until further court orders are issued.
“Yesterday was the first of what I hope are many victories for Sherole,” Karla VanBibber told us via Email earlier today. VanBibber, who is Sherole’s niece attended the meeting, and described the moment when Arnebeck arrived with the court order: “The expressions on the board members faces when given the court injunction was priceless.”
VanBibber also gave us her take on the reactions from the Board Members in the face of questions from supporters about Eaton’s dismissal, which she says is illegal under Ohio law. “Their sputtering and faultering and lying was unbelievable,” she said. “It’s amazing how the arrogance we see in the Bush administrations has filtered down to the local level as it has.”
Apparently, they won’t be giving up the fight for Eaton, who is recovering from recent brain surgery, but attended the hearing “in apparently good spirits and seemingly good health – full of energy and zeal and very appreciative of the support,” according to Evan Davis’s detailed account of the meeting at Ray Beckerman’s blog.
Said VanBibber, “We knocked them down a few notches yesterday, we won’t give up until they’re on their knees and Sherole has her job back.”
Eaton’s firing, and her dramatic appearance at another recent Board of Election hearing, just two days surgery, was covered in this previous BRAD BLOG report.
Hocking County’s Logan Daily News also had a report today on yesterday’s meeting. “[Sherole] was so happy this morning when she received her paper,” VanBibber said, “she came over and was so excited and for the first time in awhile was optomistic.”

Then Arnebeck asked to address the board “on a point of order.”
“We filed a complaint for a declaratory judgment and preliminary and permanent injunctive relief against any action to terminate or replace Sherole Eaton as deputy director,” Arnebeck said. “All I want to do is serve the board with a copy of the order to restrain it from taking any further action on this matter until further action of the court.”
Spectators in the room applauded as Arnebeck lay the order on the desk before Robinette.
Apparently Board of Elections officials have yet to go on record as to the cause of Eaton’s firing. According to Davis, the most the Board has said is that they “weren’t satisfied with her performance.”
At the meeting on Tuesday, however, VanBibber painted a different picture in her direct questioning of the board’s chair, Gerald Robinette. “You praised her personally at the Democrat meeting until the incident with the TRIAD technician. She was competent, and did a great job, and suddenly she became incompetent?”
The board refused to answer, according to Logan Daily News.
Eaton’s firing has drawn national attention. Rep. John Conyers’ (D-MI) was quoted in a Daily News article in May, describing Eaton as having come forward “bravely” to report on the tampering by Triad employees during the recount. He told the paper that “Absent any other explanation, and having been told at the time of the incident that Ms. Eaton was an excellent employee, I can only conclude that Ms. Eaton’s firing was solely out of retaliation.”
Much has been made, of late, regarding the supposedly “bi-partisan” Boards of Election in Ohio. Mostly by the Secretary of State J. Kenneth Blackwell in defending the November Election debacle and its subsequently spoiled recount. Blackwell, in charge of elections in Ohio, and incidentally the co-chair for the Bush/Cheney Re-Election Committee, has repeatedly claimed that the “bi-partisan” nature of the boards precludes any chicanery favoring one side or the other.
Nonetheless, a great deal of evidence has surfaced of late to suggest that the “Democrats” on many of these boards are Democrats in name only.
In describing information that Davis received from Eaton, who “intimated” to him that a replacement for her has already been chosen, the replacement is described as “A part-time BOE employee who has been an active Republican but who registered as a Democrat in the last primary election, presumably in order to qualify as a candidate for Sherole’s position.”
Davis spoke with Robinette after the meeting to discuss the new mandate by Blackwell to purchase touch-screen voting machines made by Diebold, Inc. in Ohio. He asked about how votes on such machines could be verified in the event of a recount. According to Davis, Robinette told him, “You’re more knowledgeable than I am on that. I really don’t know. All I know is that they’re certified by the federal government and they’re being mandated by the Secretary of State.”
Davis also said that Robinette went on to say “that the old punchcard system was perfectly adequate in his view and that he resented the Sec. of State. ‘pushing (the county) in to something ( DRE’s ) that wasn’t really necessary.'”
The dramatic hearing also reportedly resulted in an admission by one of the Republican members of the Board, Lisa Schwartze, that she conducted Republican Party business during working hours and on Board of Election property.
While Schwartze admitted to some of the charges, she contested others and the issue was tabled by the chair for a further meeting.
VanBibber also told The BRAD BLOG today that Harpers Magazine would be running an article on Eaton in their August issue, and that she’s “received a call from the BBC expressing an interest in doing a movie about her battle.”

It will be interesting to see if there is any attempted re-retribution later. I would hope the bloggers rise to the occaision should retribution come later.
A time delay should not be an excuse to forget those who stood up to solve the problem; not should a lag in time be an excuse to be slow in coming to their aid when they may be more vulnerable and out of the spotlight.
Stay close and be ready to make waves if there are problems down the line, no matter how many years later they may choose to seek vengeance.
At the very least, there should be a public accounting for those who took retribution already; indeed, they have much to explain especially when there are questions as to what pressure the White House and Gonzalez have put on those to keep silent about the voting fraud.
Moreover, these are matters which need to be brough up during the confirmation hearings, especially sine Gonzalez looks like he’s gotten a green light. The last thing we need on teh Supreme Court is soneone who thinks it’s "OK" to commit torture.
Gonzalez remains an alleged war crimminal and should not be given a serious review, but a filibuster.

I’m a long way from trusting this completely corrupt Ohio government to consider wasting any more effort to vote, but this is a welcome victory for a well deserving person.
These people will never give up their control, but this will certainly expose some of them for the rats they are.
Thanks goodness for people like Eaton who are willing to speak out and who refuse to be intimidated. And same for Arnebeck who has been equally willing to put his head above the parapet on her behalf.
Apparently we Dems need to work very hard to reveal all the Republicans wearing Democratic labels to get on a Board of Election or other election offices.
This is a fundamental requirement for protecting the interests of Democratic voters!

Easily. This graph shows a comparison between actual exit poll completion rates, and final vote counts across each state.
In Graph 1, Kerry’s % of the state vote, in ascending order, left to right.
In Graph 2, Corresponding Exit poll completion rate, left to right.
For both graphs, the best fit-straight line has been calculated.
y = a + bx is the equation of a straight line, where b is the slope.
Both "best-fit" linear equations are clearly stated and shown as dashed lines on the graph.
Now watch the regression:
Kerry’s vote percentage increases in states going from left to right (increasing slope). The corresponding state exit poll completion rates decrease (negative slope).
Easy answer:
There is a negative correlation between Kerry’s vote and the completion rate. They move opposite to each other.
Since the completion rates and vote %s move opposite of eachother, it is clear that the opposite answer has been achieved versus Mitofsky’s responder analysis.
States moved opposite eachother in the single graph moving farther and farther apart from recorded vote, particularly in states Ohio, Nevada, Florida.
The single state of Ohio observed one of the largest anomolies, strongly showing there was an abundance of manipulation.

The newly-found vulnerabilities described in the Black Box Report
are critical, and not fixable with any software patch or minor change.
Bear in mind that when Diebold acquired Global Election Systems,
its investment banking partner performed, (or should have done) a
due diligence analysis of this system. Diebold Inc. either knew, and
sold the system anyway, or did not know, but should have known.
It is therefore appropriate that Diebold should foot the bill for
the product recall. Certainly not the taxpayers. To take actions for a

Used to count at least 25 million votes in the Nov. 2004 election,
(2.5 million votes in Florida alone, or one-third of that state), the
Diebold memory cards for this system need to be sequestered
and examined.
Done correctly, the ballot box manipulations (memory card tampering)
described in the Black Box Report will leave no telltale signs in the
paper audit trail.
– In areas like Volusia County and Brevard County Florida, where
significant anomalies have appeared related to vote tabulation,
memory cards, or poll tapes, the memory cards should be certainly
inspected by someone experienced in forensics.
– Because this system is so open to tampering, please urge your local
and state officials to sequester the memory cards for recent elections,
so that they can be examined by a forensic expert, or an otherwise
qualified expert, like Hursti, who has shown that he is both competent
to evaluate this issue, and forthcoming about notifying the public.
These memory cards are clearly of public interest, and should be
deemed a public document.
– Please urge local and state officials to have a competent,
qualified examiner evaluate both the new optical scan systems,
including the high speed central count system, and the touch-
screen systems, because there are some indications that this
architecture is being used (and even increased) in newer versions.
The touch-screens may be using a different but similar architecture.

Diebold took advantage of pre-holiday distractions to tuck an earnings
restatement into the press, admitting its management had uncovered an
"accounting mistake" in its ATM division. Sliding in alongside were
safe harbor-type concerns about its election systems. Black Box Voting
feels that this particular SEC disclosure will turn out to be of special
interest, given what we have learned from our own investigations. Note
the following items listed by Diebold: — "potential security violations
to the company’s information technology systems" — "challenges raised
about reliability and security of election systems products, including the
risk that such products will not be certified for use or will be decertified"
— and "unanticipated litigation, claims or assessments".
Bear in mind that such "safe harbor" statements are typical for public
companies, who must include potential downside events in SEC-
required statements. In fact, of more importance is when these specific
statements started appearing, or any changes in these statements.
However, Black Box Voting feels that this particular earnings
restatement, and these particular safe harbor statements are of special
interest, because:
– Security violations have become an even more significant concern now
that The Black Box Report is out. A product recall of the Diebold Precinct-
based Optical Scan 1.94w system is advisable, along with examination of
certain items from recent elections.
– Issues related to compliance with the Sarbanes-Oxley Act
may surface in connection with two other problems our investigations
have uncovered:
– Apparently incorrect public statements to regulatory bodies, by
Diebold Election Systems, about the amount of money spent on
lobbyists and "success fees," based on a comparison of the amounts
in publicly disclosed reporting forms vs. check stubs and financial
statements obtained by Black Box Voting
– Improper management of accounting documents, specifically, failure
to safeguard documents (see auditing internal control over financial
reporting guidelines, by placing nearly 400 pages of sensitive financial
statements for the Diebold Election Systems division into various
unsecured dumpsters easily accessed by the public.
These documents include check stubs, financial statements (including
in-house financial worksheets for Diebold Inc.), invoices, accounts
payable ledgers, accounts receivable ledgers, a cryptic financial
statement pertaining to a $390,000 employment litigation matter
in the Canadian Diebold Elections Systems office, in-house worksheets
showing calculations for budgeting, payroll records, post-it notes,
inter-office memos pertaining to budgets, purchasing, and sales plans,
and unusual payments that should be further investigated.
After seeking legal advice on what to do with these documents,
Black Box Voting decided to turn them over to the SEC for an
evaluation of their impact with regards to the Sarbanes-Oxley Act,
and the management responsibilities amendment to that act.

I mean just look at this sad state of shitty affairs. If this was not a civil country and our laws did not deter people from severe beatings, I’d be inclined to go up to our congress represenatives offices and forcably bend them over: Then beat them long and hard with a spanking paddle.

AT LAST–a full account by Vickie Karp of the Election Assessment Hearing in Houston. This was the event organized by Kip Humphrey which featured the *real* election reform activists. The media were conspicuously absent.
Karp includes excellent summaries of all of the witness testimony, plus an account of the questions put to latecomer Robert Pastor (he of the Carter-Baker Commission who was convinced that all his email came from only "six or seven" Brad Bloggers)–and his embarrassing non-answers.

Galloway Wary of Staged Terror Attack as Pretext for Iran Invasion
I was lucky, I missed the Liverpool Street bomb by half an hour on my way to a job interview.
By the time the interview was over, 37 people were dead and 700 were wounded and central London was cordoned off, no buses, no tubes, no trains and no taxis. Lots and lots of Ambulances, Police cars and Fire Engines – sirens non-stop for over 3 hours.
The mobile networks were overloaded, so I couldn’t call my family to let them know I was okay until after 11:00.
So far as I know all my friends and family are okay, I got lucky – I just had to walk six miles home in the rain. All things considered, I’m totally cool with that.
I don’t wish to sound paranoid, but does this happening less than a week after the British Military announced a pull out of Iraq smell fishy to anyone else?

At the same time, I can’t help thinking how much worse things are in Iraq than anything being experienced in London. The disruption, fear, chaos, injuries and death are ongoing there. I wouldn’t wish these experiences on the people I find most distasteful. I wish the folks who are running things behind the scenes would wake up and realize what they are doing and make some contact with the human suffering they are creating.

Since Kerry exit poll interview takers were less likely to be polled and the trend kept decreasing across state, fraud & manipulation are the only viable explanation.
Kerry interviewers kept declining in rate the reverse of the trend Mitofsky claims happened.

I heard from a friend today that I’ve not heard from in a long time, who sounded the ALARM about the "curious coincidence" of this attack coming at the time of the controversial G8 Summit in Scotland. I don’t think she would mind my quoting her here:
"What kind of idiot terrorists are these? They could have (and should have if they had two brain cells to knock together) attacked this controversial Summit meeting. Why not? Whose agenda is being promoted by these attacks – certainly not the terrorists. And, why is security always so great that the leaders are never hurt while every other form of security seems to be headed up by the Keystone Cops? Are we not supposed to notice this?
Listen to how Bush portrays the G-8 nations and leaders as the GOOD guys and the terrorists as the BAD guys!. Come on! The major news story seems to be how this terrorist attack won’t stop these GOOD leaders from completing their meeting. Now, people will become united to support the G-8 meeting to keep the BAD guys from spoiling the fun. See how the result is being manipulated to benefit the G-8? Doesn’t it look like these two teams are really on the same side? According to them, am I on the side of the terrorists because I don’t support the G-8?"

I shudder to think that America has been taken over by some sort of electronic coup but that is what it really looks like at this point.
