Another good reason that a mail-in primary do-over cannot happen in Florida? It is against the law. State law only allows referendums to be on a mail ballots and doesn’t allow for candidates to be named on ballots via stamp and carrier. An executive order or a law change would be needed to allow the presidential primary to be recast.

On top of today’s Mississippi primary we also had a special election for Indiana’s 7th CD and municipal elections in Florida.

Today the Iowa senate approved a bill (47-1) that will change the state to a paper ballot and op-scan state from one that had a mix of optical-scan and DRE counties. The bill now goes to the House where it is expected to pass. …

    Looks like the vote for telecom immunity is going to make the_zapkitty plesantly surprised. Lets hope so:

    I want to dispute this this but all I can say is John Gideon says it’s illegal. ( I believe you 🙂 but is there a link to that law I could use also? Thanks.

    To add to my previous question and confusion…
    Comments I am seeing on a few blogs is that in this case “a mail-in vote would be legal because it is a party function, not a state function.” ???

    What I put up in the lede graf of DVN is, most of the time, something that is picked out of the news articles that are linked below that graf.

    One news item said a mail-in election is illegal when it includes candidates. However, another article said this:

    Is it legal?

    • Florida law doesn’t allow mail-in only voting between candidates. Dew said because the party would conduct the vote it wouldn’t have to follow the state law.

    • Gov. Charlie Crist said a privately financed mail-in ballot administered by the state would need legislative approval. But, he acknowledged that a recent court case raised the possibility that it could be done even without a state legislative vote.
