Mukasey Confirmed in Senate 53-40

Six Democrats Vote with Lieberman and GOP to Rubberstamp Bush's Torture Policies

Olbermann Suggests Mukasey Will Provide Cover for Bush Against War Crime Charges

Share article:

Guest blogged by Jon Ponder, Pensito Review.

Until last night, the criminal responsibility for the torturing of terror suspects by the U.S. government was entirely on the heads of George Bush, Dick Cheney, their senior aides and the civilian and uniformed military leadership who approved and implemented “advanced interrogation techniques” such as waterboarding.

Late in the evening yesterday, however, the U.S. Senate, including all Republicans who were present, Sen. Joe Lieberman (I-CN) and six senior Democrats, willingly assumed responsibly for Bush’s torture policies by rubberstamping his nominee, Michael Mukasey, to be the next U.S. attorney general.

Mukasey — a crony of Rudy Giuliani, the Republican presidential candidate who, during his tenure as New York City mayor, revealed fascistic tendencies that are alarmingly similar to those of George Bush and Dick Cheney — indicated during his confirmation hearing before the Senate Judiciary Committee that he will continue to greenlight Bush’s torture policies.

Now the question is, will Mukasey also assist Bush, Cheney and the rest in trying to avoid war-crimes charges after they leave office.

The six senior Democratic senators who voted to confirm Mukasey and thus condone torture were:

  • Charles Schumer (N.Y.)
  • Dianne Feinstein (CA)
  • Ben Nelson (NE)
  • Evan Bayh (IN)
  • Mary Landrieu (LA)
  • Tom Carper (DE)

Profiles in courage among senators who are running for president — including a senator who was a prisoner of war — were also absent last night:

All four Democratic presidential candidates – Sens. Hillary Clinton (NY), Barack Obama (IL), Joe Biden (DE) and Christopher Dodd (CN) – missed the vote, as did Sen. John McCain (R-AZ), who is seeking the GOP presidential nomination in 2008.

Sens. John Cornyn (R-TX) and Lamar Alexander (R-TN) also did not vote.

Beyond the disgrace Bush’s torture policies have brought to the nation, earlier this week, MSNBC newsman Keith Olbermann asserted that George Bush understood that waterboarding was torture, and thus a crime under domestic and international law, when he approved it in 2003.

In a “Special Comment” on Monday Olbermann recounted the story of Daniel Levin, a Bush Dept. of Justice official who voluntarily submitted to waterboarding so that he could judge for himself whether or not it was torture. Afterwards, when Levin declared that the drowning technique was indeed torture, Bush had him fired.

Olbermann suggested that Bush’s real motive for torturing suspects was to keep terror plots coming — even the ones that were lies invented by tortured men desperate to bring an end to their agony — in order to perpetuate the climate of fear Bush requires in to keep his terror-addicted base of dim-witted paranoiacs and Christian nationalists in line. Here’s how Olbermann concluded his editorial on Monday night, addressing George Bush personally:

Now, if that is what this is all about, you tortured not because you’re stupid and you think that torture produces confession, but you tortured because you’re smart enough to know it produces really authentic sounding fiction. Well then you’re going to need all the lawyers you can find, because that crime wouldn’t just mean impeachment. Would it, sir? That crime would mean George W. Bush is going to prison.

Thus, the master tumblers turn and the lock yields and the hidden explanations can all be perceived in their exact proportions and in their exact progressions. Daniel Levin eminently practical, eminently logical, and eminently patriotic way of testing the legality of water boarding had to vanish and him with it. Thus Alberto Gonzales has to use that brain that sounds like an old car trying to start on a freezing morning to undo eight centuries of the forward march of law and government.

Thus Dick Cheney has to ridiculously assert that confirming we do or do not use any particular interrogation technique would somehow help the terrorists. Thus Michael Mukasey, on the eve of the vote that would make him the high priest of the law of this land, cannot and must not answer a question, nor even hint that hes thought about a question which merely concerns the theoretical definition of water boarding as torture. Because, Mr. Bush, in the seven years of your nightmare presidency, this whole string of events has been transformed from its beginning as the most neglectful protection ever of the lives and the safety of the American people, into the most efficient and cynical exploitation of tragedy for political gain in this country history.

And then to the giddying prospect that maybe you could do what the military fanatics did in Japan in the 1930s, and remake a nation into a fascist state so efficient and so self-sustaining that the fascism itself would be nearly invisible. But, at last, this frightful plan is ending with an unexpected crash. The shocking reality that no matter how thoroughly you might try to extinguish them, Mr. Bush, how thoroughly you might try to brand disagreement as disloyalty, Mr. Bush, there are still people like Daniel Levin who believe in the United States of America as true freedom, where we are better not because of schemes and wars, but because of dreams and morals.

Mukasey is a former judge from New York City who, despite his Republican Party affiliation, was reportedly highly regarded in the liberal enclave. Now that he has agreed to join the Bush administration, his reputation is destined for the ash heap of history alongside other once-respected figures like former Sec. of State Colin Powell, who have colluded with the Bush regime.

Therefore, “all Republicans who were present, Sen. Joe Lieberman (I-CN) and six senior Democrats” must hate the troops because “Former Navy instructor Malcolm Nance said he considered it a “guarantee” that other nations now have “a legal standard to subject American soldiers to enhanced interrogations” http://www.tpmmuckraker.com/archives/004669.php

In our wonderfully technically advanced society everyone should have big smiles on their faces. We won, we are at the top of the food chain. We have scientists and prefab molded houses with running hot water and super fast internet connections. We have rocket ships that take us to the moon. We have portable cell phones for awesome portable communication and digital music players for jamming out. We are so awesome and advanced and smart and evolved. Humans from hundreds of years ago should be jealous of our greatness.

Yet we still torture people at a medieval level.

Might I suggest a subscriber web cam for torture enthusiasts.
Or how about using Gatoraid instead of water, You know it’s got electrolytes in it.
Maybe we can make a machine to recycle the water being used for the water boarding so we don’t waste to much of it. Or even use the fecal matter being produced when victims(I mean lucky contestants) poop themselves for power of said machine.

That being said I encourage all of you to visit my ebay site and buy my (patented) home version. You get a board, a cloth, some shackles, and an attachment to go on your garden hose, plus for a small fee you can have your very own gitmo detainee for exclusive in your home interigation.

What to much you say, OK

I’ve also got a set specifically designed for kids. Now your kids can play interrogation with the neighborhood kids. This set is the same as above only everything is smaller. Sorry no detainee with this set you will have to use a dog or other small creature if you are by yourself.

Troops are just “fodder” to Rethuglicans. Really, they would prefer to conduct their wars from the sky with easily dropped bombs, but the reality of War makes that impossible for these chickenhawks to comprehend.

Because they have never BEEN in war and do not understand the possibility of torture of OUR soliders, they have no compunction of violating international laws and standards of human decency.

    Human scum one and all.

They are too nice to stop fascism, just like the nice German folk who were too nice to stop Hitler.

Remember what happened to those Germans. The world is watching us go psychotic, and so is the earth.

The problem will be taken care of harshly if we do not take care of it decisively.

I will vote for none of the enablers of fascism. Not one of them. In fact I will vote against them!

Great summary of what is taking place in America Jon. I just hope that if we Americans can’t or won’t vote all these idiots and traitors out of office, another country will occupy this nation and help us create a democratic government.

    A Sad Day.

Dredd, make a voting chart. There’s so many fascists, I can’t keep up anymore. I too don’t want to vote for one of em. (That is if my vote even get’s counted.)

We need a national list/chart. It’s insufficient to just look up one guy at a time now (while each one tries to hide and bury his or her shit), we need a list of them and how they took action on different issues.

    take the biggest issues,

    impeachment
    bring the troops home
    habius corpus
protect the constitution or break their oath of office.

Side note: Too bad I didn’t go to SF, last weekend I wanted to go and do some video and photography, but now we have oil everywhere since a cargo ship slammed the bay bridge. Friggin DEVESTATION on the west coast.

Let’s not give the Republicans a pass on this because we EXPECT them to vote for torture!!! 6 Democrat traitors and THE ENTIRE REPUBLICAN PARTY are for torture!!! How come in the media the Republicans get ZERO heat for 100% of them voting for Mukasey??? Because we KNOW the Republicans are Nazi’s??? And that’s “OK”???

I am so frustrated by this; the Republicans fool the Democrats over and over. I think that the democrats should listen to Henry Rollin’s “LIAR” just before the dems do any negotiations with the pubes. Talking with Mukassey in a private session before voting for him is not good enough as the Bush Adminsitration most likely had that conversation bugged. National Security Directive #51 sets up martial law, and we could all be tortured. I will think of you as I am being toruted…or whatever they will be calling it then.
My vote is now for courageous Kucinich..I have sent money..and he has my time as a volunteer.

I wish the Dems would quit whining about not having enough votes. Why don’t they raise hell? Why don’t they do everything in their power to stop Bush? Cut off the money!!

    Are they on the take?

    Are they being blackmailed?

Are they so worried about hurting their chances for the presidency that they’ll ignore the will of the people and allow troops to die in Iraq for another year?

Short of Hillary eating a baby on national television, I don’t think that their is any ballsy move that would hurt their public image and make people vote Republican.

Everyone knows that Bush is psycho!! What’s the delay?

I have sobered up from my binge on hope wine. Hoping America still exists was just a stone fantasy.

I am thinking of voting green candidates for every office for the rest of my days, not just local offices.

But Big Dan #8 makes a good point. Voting is mostly punishment these daze. It would punish the republicans to vote in democrats and vote out republicans, however, it is very little punishment.

The dems become corrupt too quickly once they get into office.

I suggest greens have a better psychological profile to resist the corruption.

The bottom line is anything but republicans for the next 3-5 elections. And I think a move from dems too, toward greens, would be the apex.

We simply do not have enough true Americans running any more … they are mostly war mongering horrids.

I think the BIGGEST point of all…is that EVERYONE (us, the GOP, GOP voters, CMSM, the internet…etc…EVERYONE) says NOTHING about the 47 of 47 REPUBLICANS voting for Naziism/torture…and the 6 of 46 Democrats get lambasted by EVERYONE (see my desc. of “everyone” above).

Now, these 6 Democrats DESERVE it! But the ENTIRE REPUBLICAN PARTY DESERVES IT MORE!!!!!!!

And no one says ANYTHING about the ENTIRE NAZI REPUBLICAN PARTY who vote 100% in LOCKSTEP!!! ALL THE TIME!!!

Everyone’s crucifying Schumer & Feinstein (and they deserve it) but saying NOTHING about 47 of 47 Republican “YAY” votes for Mukasey!!! WHAT…..THE….FUUUUUUUUUUUUUCK!!!!!!!!!!!!!!!!!!!!!

NeilDeal said: “I wish the Dems would quit whining about not having enough votes. Why don’t they raise hell? Why don’t they do everything in their power to stop Bush? Cut off the money!!”

Exactly what I’ve been saying for a while. If the Dems REALLY want to end the war in Iraq they can do so pretty easily. They’re in the majority in both houses, granted it is paper thin but still a majority. The Cheney regime has to fund the Iraq war piecemeal with supplemental funding bills instead of in yearly lump sums attached to the defense budget. All they have to do to end the war is to en bloc refuse to vote on supplementals. No law says any representative has to vote on any particular bill. If the bill doesn’t get voted on it can’t be passed and if it can’t be passed it won’t end up on Bush’s desk for signing. Since Bush and Cheney can’t send spending bills to their own desks, as it has to come from Congress, they are screwed without Congress continuing to be their enabler via sending them spending bills to sign. Just don’t vote on supplementals, pretty simple.

Instead what do they do? Yesterday the Dems unveiled some convoluted Rube Goldberg device of a bill that continues to fund the Iraq war to the tune of $50 bilion over four months, on the condition that within 60 Bush has to present a plan to complete troop withdrawls by the end of 2008, and would limit the occupation force’s role to “counterterrorism”. OK, so if this passes do they honestly think Bush isn’t going to veto it with the obvious conditions they’ve put on the money? Then what do they do? They throw up their hands and put on a fake grimace and say “Well, as you can see we don’t have the votes to override any veto… Sorry, but we can’t end the war.” This is so transparently phony when all they have to do does NOT require writing a bill for Bush to quickly veto then rolling over because they can’t override it. All they are doing is presenting a false choice, between doing nothing and writing a bill for Bush to veto. All they are doing is trying to make it LOOK like they are making an effort to end the war when they are doing nothing but acquiescing and spinning their wheels. If they were a genuine opposition party they would listen to the will of the people and end this war in Iraq starting monday by publicly refusing to ever again vote on supplemental funding for the Iraq war, putting the onus on the Cheney regime to either pull the troops out while there is still money left in the metaphorical pipeline, or letting them wither on the vine until they DO run out of money, and have to withdraw chaotically. Either way it will be on Bush/Cheney and either way the war will end pretty soon. But they won’t do that. Why? Because they’re fake. Because they DON’T represent the will of the people but the will of the warmongering establishment.

Hey, guys. Is this issue really this simple? A vote for Mukasey is a vote for torture? I’m hearing some mixed messages, that many Democrates have a lot of respect for Mukasey, and that Feinstein got assurances from Mukasey that he would never condone waterboarding or other forms of torture. Other than his refusal to answer this question in the hearings he is the best candidate that could possibly be expected. Is all this bullshit?
Personally I have a great deal of repect for Joe Biden. If he didn’t vote, I expect there is a good reason. I would just like to know what the real deal is here.

  23. 39)
Lev said on 11/12/2007 @ 2:38pm PT: [Permalink]

If the Dems were a real opposition party then no Iraq war supplemental spending bill would make it out of committee to even be voted on. They would make it plain to Bush that Iraq war spending bills aren’t on their legislative schedule and he would be forced to withdraw the troops while there is still money in the pipeline so to speak. But they don’t do that; instead they write bills that they know Bush will veto so they can have political cover, APPEARING to be trying to do something to end the war when all they’re doing is serving the pro-war establishment, not their constituents.

Regarding Mukasey, he in most Orwellian fashion dissembled and refused to state the obvious, that holding someone down and pouring water in their mouth and nose until they are a hair’s breadth away from drowning, is torture. Certainly he knows it’s torture; certainly his playing dumb on the issue was politically calculated to not expose his future bosses. This is the man who is to be the next head of the “Justice” Department? This is “the best we can hope for” from the Cheney regime? Who said they had to confirm any attorney general selectee at all? How much worse would the country be than it is now if it has nobody at the helm of its gestapo I mean “Justice” Department for the remainder of Cheney’s term in office? Granted, most of the Dems voted against his confirmation but enough rolled over to let the Repubs win. Again. Beyond this Mukasey issue, in a larger sense why are the Dems acting like they are still in the minority in Congress? See what I wrote above. They’re fake. ‘Nuff said.
