BREAKING: Scott Walker’s Anti-Union Law Struck Down by WI Judge as Unconstitutional, ‘Null & Void’

Just breaking from AP:

MADISON, Wis. – A Wisconsin judge has struck down the state law championed by Gov. Scott Walker that effectively ended collective bargaining rights for most public workers.

Dane County Circuit Judge Juan Colas ruled Friday that the law violates both the state and U.S. Constitution and is null and void. The ruling comes after a lawsuit brought by the Madison teachers union and a union for Milwaukee city employees.

Walker spokesman Cullen Werwie says he is confident the decision will be overturned on appeal.

It was not clear if the ruling means the law is immediately suspended. The law took away nearly all collective bargaining rights from most workers and has been in effect for more than a year.

UPDATE: In a series of tweets posted just moments after the verdict was announced by AP, Walker responds to the ruling:

The people of Wisconsin clearly spoke on June 5th. Now, they are ready to move on. Sadly a liberal activist judge in Dane County … wants to go backwards and take away the lawmaking responsibilities of the legislature and the governor. … We are confident that the state will ultimately prevail in the appeals process.

UPDATE 9/15/12: Much more now on the Judge Colas’ ruling now from Milwaukee’s Journal-Sentinel

  1. Well it’s about GOD DAMN TIME somebody stood up for humans being! Ya know, it doesn’t make me more defeated when the poisonous shit keeps rolling…it makes me sharper and more willing to stand up and fight this congressional corporate sucking machine. And it is always nice to see someone who gets it! Good on you Judge!!!!!!!!!!!!!!!!!!!!!!!!!!!!

  2. Thanks, Big Dan. AP did the switcheroo, as they often do, by updating the story.

Have re-linked to TIME’s version of the AP story (identical to the one I initially linked to), and added another UPDATE with a link to a Journal-Sentinel story with many more details now available.

  3. This may be just another example of me being yet again one-step-behind-the-fun but I just read that it’s widely believed Karl Rove was the aide from this famous Ron Suskind bit–

The aide said that guys like me were “in what we call the reality-based community,” which he defined as people who “believe that solutions emerge from your judicious study of discernible reality.” … “That’s not the way the world really works anymore,” he continued. “We’re an empire now, and when we act, we create our own reality. And while you’re studying that reality—judiciously, as you will—we’ll act again, creating other new realities, which you can study too, and that’s how things will sort out. We’re history’s actors . . . and you, all of you, will be left to just study what we do.”

This helps explain the ongoing Vesuvian nonsense coming outta so many Republicans these days(the Romney campaign, anything Scott Walker says, etc). They really believe they can say whatever they want. That they can create their own reality. Fuck the facts. Fuck the fact checkers. Fuck you. And fuck me.

Hi George. Thanks for the warning.

  4. How fitting, since the damn union-busting bill was so shamefully ratified. The bill itself was passed illegally in violation of Senate rules. The state judge struck it down leading to the appeal to the Court.
Without a decision the union busting would have to be added to the State budget bill to allow the disgusting cuts to school districts.
Huge protests would have resulted. Senate leader Fitzgerald demanded a ruling and the Court complied.
The WI Supreme Court was only supposed to be deciding to accept the case, not to rule on it.
On that fateful day the Republican majority issued a decision anyways with Prosser resorting to physical assault on another Supreme.
Not only that but Judge Prosser freely admits to illegal electioneering when he was a state lawmaker, the same crime Scott Walker is under Federal investigation for.
Reince Preibus was accepting those illegal emails from Walker’s assistant 25 feet away that Walker is shocked to learn about.

  5. Walker forced on the state his Koch planned attack on unions and collective bargaining. He may not have been recalled but that does not mean people in the state supported his attacks against union rights.
